Terrorist attacks can happen anywhere, at any time, and carry with them crippling results. Aside from being a direct target of a terror attack, you are still exposed even if your assets or business are not directly hit.
The threat of terrorism continues to grow, with groups such as ISIL and Boko Haram attracting new followers. What’s most worrying, though, is the rise in so-called “home-grown”, lone wolf terrorists, who are able to strike fear into the nation without the full backing of a larger group.
Since congress enacted the TRIA act in November of 2002, there has NEVER been a claim covered under TRIA because the government has failed to “certify” them.
This means that the Boston marathon bombing, as well as recent incidents in San Bernardino, California; Charleston, South Carolina and Chattanooga, Tennessee, have not paid out anything to policyholders.
The current program has cost the government approximately 1m a year but has made an estimated 40bn for insurance companies.
Congress has failed to take any action to change this practice, meaning that you are paying for insurance that won’t pay out even if there is a terrorist attack.
Clearly, it’s time for change.
What does “Certified” mean ?
Policyholders can only claim through their current TRIA coverage if the act is deemed to be “certified”. This “certification” comes from a decision by the Secretary of State, the Secretary of the Treasury, and the Attorney General of the United States. They need to determine that the act meets all the following criteria:
• It is considered an act of terrorism.
• It is violent or dangerous to human life, property, or infrastructure.
• It results in damage within the United States, (including US air carriers, vessels, and/or US missions, as described in the Act).
• It is committed by an individual or individuals, as part of an effort to coerce the US civilian population or to influence the policy or affect the conduct of the US government by coercion.
